Lotcrest creates illustrative outdoor design concepts for recently sold homes using public records and licensed aerial imagery, and mails homeowners a personalized invitation to view their design. This policy explains what information we collect (including data we gather from public records before we ever contact you), how we use and share it, and the choices and rights you have — including a permanent, one-email opt-out.
1. Introduction
This Privacy Policy describes how Lotcrest LLC, a New York limited liability company (“Lotcrest,” “we,” “us,” or “our”), collects, uses, shares, and protects information in connection with our websites, personalized design pages (each, a “pURL”), direct mail program, partner portal, and related services (collectively, the “Service”).
Lotcrest is a marketing and lead-generation company. We identify recent home sales from public records, create an illustrative, AI-assisted outdoor design concept of the property, and mail the homeowner a personalized postcard. If the homeowner chooses to engage, we connect them with a licensed, insured local contractor partner (a “Partner”) who performs any actual work. We take privacy seriously and have designed the Service with several protections built in: we never publish your address or images of your home, our renders are labeled as illustrative, and opting out of our mail is permanent. This policy explains our practices in detail and describes the choices and rights available to you.
2. Information We Collect
We collect three categories of information, and we want to be transparent that the first category is collected before we have any relationship with you:
(a) Public-records and property data. We collect information about properties from government and licensed sources, including recorded deeds and sale records, parcel boundaries, lot size, assessor and tax-roll data, and aerial imagery licensed from government sources (such as New York State orthoimagery — we do not use Google imagery or content). This information is a matter of public record, and collecting and using it for lawful purposes, including marketing, is permitted by law. It relates to the property and its transaction history; it is how we know a home recently sold and what the parcel looks like from above.
(b) Information you provide. If you choose to submit the form on your design page (or otherwise contact us), we collect the information you give us: your name, email address, phone number, and any project notes or preferences you share. We also record the details of your consent to be contacted — including the consent language you agreed to, the date and time, and the IP address from which the form was submitted — and store that consent record immutably as legal evidence of compliance with telemarketing laws such as the TCPA.
(c) Usage data.When you scan the QR code on your postcard or visit a pURL or our website, we automatically collect usage information such as the fact and time of the scan, pages viewed, device and browser type, operating system, IP address, and similar technical data, using cookies and similar technologies as described in the Cookies & Analytics section below.
3. How We Use Information
We use the information described above to:
- create the illustrative design concept for a property and prepare and deliver the personalized mail piece;
- display your design to you on your personal page and respond to your questions;
- connect you with a licensed, insured local Partner — but only if you ask us to by submitting the form with the consent checkbox;
- contact you by call, text, or email about your design and related services, in accordance with the consent you gave;
- honor opt-outs and suppression requests, and maintain records demonstrating our compliance with applicable law;
- measure what works — for example, how many postcards lead to scans and inquiries — and improve the design quality, mail targeting, and overall Service; and
- secure, maintain, and troubleshoot the Service.
We do not use the information you provide to build advertising profiles of you for third parties, and we do not use your contact information for any purpose beyond the ones described in this policy.
5. Direct Mail & How We Chose You
If you received a postcard from us, here is exactly why: when a home is sold, the deed is recorded with the county and becomes a public record. We monitor those public records, and a recent sale of your home is what triggered our mailing. We did not obtain your address from a data broker’s marketing profile, from your online activity, or from any private source — it comes from the same public land records available to anyone.
We hold ourselves to a few rules in this program. We never publish your address or images of your home — your design page is private to its unique link, is not listed or indexed, and is not shown to other visitors. The design on your postcard and page is an illustrative concept generated with the help of AI and licensed aerial imagery; it is labeled as illustrative and is not a survey, plan, or offer. And if you tell us you don’t want to hear from us, we stop permanently — see the next section.
6. Your Choices & Opt-Out
Do-not-mail. You can ask us to never mail you again by sending one email to info@lotcrest.com or by using the opt-out link printed in the footer of our mail pieces. When you do, we add your address to a permanent do-not-mail suppression list that is honored across all of our channels — mail, email, and SMS — even if your property appears in a future public-records trigger. Suppression entries are retained permanently precisely so that we can keep honoring them.
Revoking contact consent. If you submitted the form and consented to be contacted, you can revoke that consent at any time: reply STOP to any text message, click the unsubscribe link in any email, or email info@lotcrest.com. Revocation is honored across calls, texts, and email. If a Partner has already received your information, we will also instruct the Partner to stop contacting you on our behalf, and you may contact the Partner directly to exercise any rights you have with them.
Opting out of marketing does not prevent us from sending non-marketing communications you request (for example, a response to a support or privacy inquiry).
8. Data Retention
We retain information for as long as needed for the purposes described in this policy, subject to a few specific rules. Consent records (the language, timestamp, and IP address of a consent you gave) are retained as immutable legal evidence for as long as required to demonstrate compliance with telemarketing and consumer-protection laws, including any applicable statutes of limitation. Do-not-mail and do-not-contact suppression entries are retained permanently so we can keep honoring your opt-out.
Your personal contact information (name, email, phone, project notes) is deletable on request: when you ask us to delete your data, we remove it from our systems in a way that preserves only de-identified, aggregate statistics (for example, the total number of inquiries in a campaign) that no longer identify you. Public-records property data relates to the property rather than to an individual and may be retained in accordance with our business records practices.
9. Your Privacy Rights
Depending on where you live, you may have legal rights with respect to your personal information, and we extend the core of these rights to everyone we hold data about, regardless of location:
- Access — the right to know what personal information we hold about you and to receive a copy of it;
- Correction — the right to correct inaccurate personal information;
- Deletion — the right to have your personal information deleted, subject to the legal-evidence and suppression-list retention described above;
- Opt-out— the right to opt out of marketing communications at any time, as described in the Your Choices & Opt-Out section.
New York residents and residents of other U.S. states with comprehensive privacy laws may have additional statutory rights, including the right not to be discriminated against for exercising privacy rights and, where applicable, the right to appeal a denied request. If you are located in a jurisdiction subject to the GDPR or similar laws, you may also have rights to restrict or object to processing and to data portability, and the right to lodge a complaint with a supervisory authority.
To exercise any of these rights, email us at info@lotcrest.com with your request. We may need to verify your identity (for example, by confirming control of the email address or phone number on file) before acting on a request, and we will respond within the time required by applicable law.
10. Security
We use administrative, technical, and physical safeguards designed to protect the information we hold. Contact information is encrypted at rest; design pages and assets are served over encrypted connections using signed, non-guessable URLs; and access to personal information within Lotcrest is restricted to personnel and systems that need it to operate the Service.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach of security affecting your personal information, we will notify you and the appropriate authorities as required by applicable law, including New York’s SHIELD Act.
11. Children
The Service is directed at adult property owners and is not intended for children. We do not knowingly collect personal information from anyone under the age of sixteen (16). If you believe a child has provided us with personal information, please contact us at info@lotcrest.com and we will delete it.
12. Changes to This Policy
We may update this Privacy Policy from time to time as our practices evolve or as legal requirements change. When we do, we will update the “Last updated” date at the top of this page, and if the changes are material — for example, a change in the categories of information we collect or in how we share it — we will provide additional notice, such as an email to the address on file, before the change takes effect.
Your continued use of the Service after the effective date of a revised policy indicates your acknowledgment of the revised policy. We encourage you to review this page periodically.
